According to an article from Medscape, a large health system is now facing a potential class-action lawsuit alleging that its use of artificial intelligence (AI) to record patient-clinician conversations violates state consumer privacy laws. Rather than challenging the use of an ambient AI tool, the lawsuit instead focuses on whether it was properly disclosed to the patient and if meaningful consent was obtained. This lawsuit is notable as it represents the first related to ambient scribe technology and has the potential to set precedent for future litigation.
